The author and publisher disclaim any liability from loss, or damage or otherwise, resulting from the guidelines set forth in this program.It is fully understand that personal injury may occur as a result of participation in the BODY PRINT Nutrition and Exercise program and the user hereby releases BODY PRINT.ca, Evolution Fitness Corp or any of its licensed representatives from any liability now or in the future including, but not limited to, heart attacks, muscle strains, pulls or tears, broken bones, shin soreness, or injury, however caused, occurring during or after my participation in the nutrition and exercise program.Before adhering to any of the information or recommendations here, please consult with your own physician or health care practitioner. BodyPrint.ca and the creators, producers, and distributors of the program disclaim any liability in connection with the advice or products advertised on this site.

SERVICE AGREEMENT

GENERAL TERMS AND CONDITIONS:

You agree to: (a) maintain all equipment necessary for your access to and use of BodyPrint.ca; (b) maintain the security of your user identification, password and other confidential information relating to your BodyPrint.ca account; (c) be responsible for all charges resulting from use of your BodyPrint.ca account, including unauthorized use prior to your notifying BodyPrint.ca of such use and taking steps to prevent its further occurrence by changing your password; and (d) updating your personal information, including e-mail address.

MEMBERSHIP TERM:

With the exception of trial memberships and special offers, the Initial Membership Term is fifty-two (52) weeks. Unless specified otherwise on this web site, each membership is automatically renewed each month and members are financially responsible for all associated renewal fees until notice of cancellation is received by BodyPrint.ca

CANCELLATION:

After the Initial usage term, members are financially responsible for the monthly membership fee until they cancel. Cancellations are not retroactive therefore, if a member cancels after their membership month has begun, the member will not be entitled to a refund for that membership month. Cancellations do not become effective until the starting date of the member's next membership month. A membership month begins on the calendar date when a member subscribes to BodyPrint.ca and concludes on the day before that calendar date the following month.

A member may cancel as follows:

By email: send an email to tylerc@evolutionfitness.ca indicating within the body of themessage your intent to cancel. Be sure to include your first and last name and user name. Please note that eDiets.com will not accept or open email communications with attachments.

By fax: send a brief letter, including your first and last name, user name and email address, and fax it to: 403-640-7826

By telephone: 403-615-0894. You will be asked to provide your first and last name, user name and email address.

WAIVER, RELEASE AND LIMITATION OF LIABILITY:

You agree that neither BodyPrint.ca or Evolution Fitness Corp.., nor its affiliates, subsidiaries, officers, directors, employees, agents, consultants or information providers or suppliers, shall have any liability to you under any theory of liability or indemnity in connection with your use of the BodyPrint.ca Personalized Nutrition and Exercise website. You hereby release and forever waive any and all claims you may have against BodyPrint.ca or Evolution Fitness Corp, its officers, directors, employees, agents, consultants, information providers or suppliers for losses or damages you sustain in connection with your use of BodyPrint.ca.

Notwithstanding the foregoing paragraph, the total liability of BodyPrint.ca and Evolution Fitness Corp. and its officers, directors, employees, agents, consultants, information providers and suppliers, if any, for losses or damages shall not exceed the fees paid by you for the particular information or service provided. All other damages, direct or indirect, special, incidental, consequential or punitive arising from any use of the information or other parts of BodyPrint.ca. are hereby excluded even if BodyPrint.ca. or its officers, directors, employees, agents, consultants, information providers or suppliers have been advised of the possibility of such damages.

NOTICE:

BodyPrint.ca may deliver notice to you under this Agreement by means of electronic mail, a general notice on BodyPrint.ca or by written communication delivered by Canada Post to your address on record in the Site's account information. You may give notice to BodyPrint.ca at any time via electronic mail to BodyPrint.ca.

Evolution Fitness Corp. maintains this Internet (BodyPrint.ca) site as a service to the Internet community. The content (images and text) is the property of Evolution Fitness Corp, and BodyPrint.ca.. You may download the content only for your personal, non-commercial use. The content may not be otherwise copied and/or modified.

BodyPrint.ca and Evolution Fitness Corp. will use reasonable efforts to include accurate and up-to-date information, but makes no warranties or representations as to its accuracy orcompleteness. BodyPrint.ca shall not be liable for damages of any kind arising out of your access or inability to access an Evolution Fitness Corp. maintained Web site or your reliance on the information contained within the Web site.
